Carbon Management Canada (“CMC” or “we”) is committed to collecting, using and disclosing personal information provided to it in the course of operating its website found at: cmcghg.com (the “Site”) and in connection with any educational or training program that CMC offers, in compliance with all applicable federal and provincial privacy laws in Canada (“Privacy Legislation”). In cases where you follow a link to a third-party website, you are no longer covered by this Privacy Policy, and any data collection or processing activity that takes place on that website will be governed by that website’s own privacy policy. CMC recommends that visitors who link to third-party websites through the Site thoroughly review the privacy policies of those third-party websites prior to providing personal information. These links are provided solely as a convenience to visitors to the Site and not as an endorsement by CMC of the contents of such third-party sites. By using this Site, you signify your acceptance of this Privacy Policy. If you do not agree to this Privacy Policy, please do not use our Site. Your continued use of the Site following the posting of changes to this Privacy Policy will be deemed your acceptance of those changes.

What is Personal Information?

The term “Personal Information” within this Privacy Policy means information about an identifiable individual, but does not include business contact information or aggregated and anonymized information that cannot identify a specific individual.

How We Collect Information About You

We use different methods to collect your information, including through:

  • Direct interactions with you when you provide it to us, for example, by filling in application forms and other forms available on the Site, by signing up to receive newsletters, by registering for a workshop or forum, or by corresponding with us by phone, email, or otherwise.
  • Automated technologies or interactions, as you navigate through our Website. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.
  • Third parties or publicly available sources, for example, our educational or training delivery partners.

Types of Information Collected

We collect information that is relevant for the purpose of providing our services, making the Site available, meeting CMC’s legal obligations, advertising and marketing our services, and researching and developing new products and techniques to improve our services, business, and websites. Examples of Personal Information that we collect and use are:

  • Information that you provide by completing forms on our Site. This includes your name, email address and any information that you provide when completing the “Contact Us” form.
  • Records and copies of your correspondence (including email addresses), if you contact CMC.
  • Information collected in connection with recruitment activities and training programs. When you apply for a training or educational opportunity with CMC, we collect Personal Information to process and respond to that application or inquiry, which may include information contained in an application form or other related materials such as contact details, demographic information and approximate location information. With respect to individuals who go on to participate in any such training or educational program, we will typically retain the information provided by those individuals in the application process along with additional information collected with consent in order to manage participation in the program and to comply with obligations owed to the Government of Canada with respect to any funding that CMC receives.

Information We Collect Through Cookies and Other Automatic Data Collection Technologies

The CMC web server may collect and retain certain information related to a computer’s visit to the Site such as the IP address and domain used to access the Site, the type and version of the browser used to access the Site, the date and time of the visit, the page that the Site was entered and exited by; and, the address of any referrer website if the visiting computer was referred to the Site by a search engine or other website.

The Site uses Google Analytics™ to record the IP addresses of computers that connect to the Site. Google Analytics™ uses these addresses to generate geographically related statistics which assist CMC with the administration of the Site. CMC does not attempt to link the IP addresses of the computers that have visited the Site with the identities of individuals. The Site also uses “cookies” which are small data files transferred to a user’s hard drive by the web browser when a user visits the Site. A transferred cookie can only be read by the Site when a user returns to the Site. Cookies are used to identify users and track their preferences so that a user’s experience with the Site may be customized accordingly. If a user does not want to have a cookie placed upon their hard drive by the Site most web browsers allow users to change this preference to disallow cookies; however, note that this could change the functionality of the Site.

How Does CMC Use Your Data?

CMC uses information that we collect about you or that you provide to us, including any Personal Information:

Except as otherwise permitted or required by applicable law or regulation, we will only retain your Personal Information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Under some circumstances we may anonymize your Personal Information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.

Disclosure of Your Information

We may disclose information, including Personal Information, that we collect or you provide as described in this Privacy Policy:

  • To our subsidiaries and affiliates.
  • In accordance with applicable law, to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of CMC’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by CMC about our customers and users is among the assets transferred.
  • To contractors, service providers, and other third parties we use to support our business (such as analytics and search engine providers that assist us with Site improvement and optimization).
  • For any other purpose disclosed by CMC when you provide the information.

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request, in accordance with applicable law.

Transferring Your Personal Information

We may transfer Personal Information that we collect or that you provide as described in this Privacy Policy to contractors, service providers, and other third parties we use to support our business (such as analytics and search engine providers that assist us with Site improvement and optimization) and who are contractually obligated to keep Personal Information confidential, use it only for the purposes for which we disclose it to them, and to process the Personal Information with the same standards set out in this Privacy Policy. Please note that we may also transfer your Personal Information outside of Quebec, including within and outside Canada, depending on the purpose for which we collected it.

We may process, store, and transfer your Personal Information in and to a foreign country, with different privacy laws that may or may not be as comprehensive as Canadian law. In these circumstances, the governments, courts, law enforcement, or regulatory agencies of that country may be able to obtain access to your Personal Information through the laws of the foreign country. Withdrawing Your Consent

Individuals who have provided CMC with their Personal Information may have the legal right to withdraw their consent to the collection, use and disclosure of Personal Information under certain circumstances. The withdrawal of an individual’s consent may affect CMC’s ability to continue to provide an individual with the products and services that the individual has or would like to receive.

Protection of Personal Information

It is important that the Personal Information we hold about you is accurate and current. Please keep CMC informed if your Personal Information changes. By law you have the right to request access to and to correct the Personal Information that we hold about you.

Individual Access to Personal Information

Upon written request, CMC will provide individuals with the opportunity to review the Personal Information that CMC has collected regarding them in accordance with the requirements of Privacy Legislation. CMC will advise the individual in advance of any charges for retrieval, reproduction or delivery of the Personal Information requested.

We may request specific information from you to help us confirm your identity and your right to access, and to provide you with the Personal Information that we hold about you or make your requested changes. Applicable law may allow or require us to refuse to provide you with access to some or all of the Personal Information that we hold about you, or we may have destroyed, erased, or made your Personal Information anonymous in accordance with our record retention obligations and practices. If we cannot provide you with

access to your Personal Information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.

Electronic Newsletters

If you decide to opt-in to our mailing list, you will receive emails that may include company news, updates, related product or service information, and similar updates. You may unsubscribe from receiving future emails at any time by following the unsubscribe instructions at the bottom of each email or by contacting us via our Site.

Children Under the Age of 13

Our Site is not intended for children under 13 years of age. No one under age 13 may provide any Personal Information to or on the Site. We do not knowingly collect Personal Information from children under 13. If you are under 13, do not use or provide any information on this Site or provide any information about yourself to us. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete that information.
